1. DELIVERABLES
All final edits will be provided via Dropbox in one single delivery 14 business days after the photography period, unless agreed otherwise.
Additional fees apply on requests for final edits to be delivered within 14 business days or less.
The Client will be provided a private link to access their deliverables for a period of 1 month from the date the link is provided. Once the link is provided to the Client, it is their responsibility to ensure that they access the Dropbox file, download and store all photographs.
The Artist will not accept requests to renew access to the Dropbox after the 1 month period. The Artist will not be liable for any loss of photographs after a copy of the same has been provided to the Client.
Requests for RAW files will not be accepted.
USAGE, IP AND COPYRIGHT
The Client is granted permission to use all deliverables provided for non-commercial use. This includes portfolios and social media posts. This is subject to the photographs remaining unaltered and photo credit is explicitly given to the Artist at all times. Any usage beyond this must be approved by the Artist.
All the above applies to associated third parties.
Our Website and all our Work are protected by copyright under Australian law and relevant international treaties.
Unless otherwise agreed with the Artist, the copyright and ownership of all work is owned by the Artist.
The Client must not deal with the Artist’s work in any way (including but not limited to publishing, copying, printing, selling, altering, transmitting and authorising someone else to do these acts), which are acts exclusively reserved to the Artist as the copyright owner without the Artist’s permission. Any such acts without the Artist’s prior permission will result in copyright infringement.
The Artist reserves all available rights to pursue legal action against any person who has infringed the Artist’s copyright over any work.
If the Client is unsure of what they can or cannot do with the contents sourced from the Artist's Website or with any work the Artist has completed for them, please contact the Artist directly on bectang.photography@gmail.com to discuss further and seek legal independent advice.
2. PHOTOGRAPHY
Unless arranged otherwise, photo shoot is to take place at the Artist's home studio. Any photography studio hire is to be arranged and booked by the Client.
If the Client's shoot goes over the allocated time by less than 15 minutes, there will be no additional charges. However, if the Client's shoot goes over the allocated time by 15 minutes or more, an overtime fee of $100.00/hour will immediately apply.
A $50.00 fee immediately applies for all shoots booked on a weekend or public holiday.
Services are dedicated to the Client only.
3. POST-PRODUCTION
Services include photo editing, photo retouching, image cropping, and image processing and optimisation. Services beyond the aforementioned will incur additional fees.
The Client understands and accepts that, unless otherwise requested, all photographs taken by the Artist will be taken and edited at the Artist’s discretion. Any requests from the Client for retouching and editing will be at the Artist’s discretion.
4. REVISIONS
Requests for revisions will be charged at $20.00 per image. No major creative changes will be accepted.
COMMUNICATION OF REVISIONS
Any images that require revision are to be expressed to the Artist within 5 business days of receiving the final edits (or previous revisions). Requests for revisions will not be accepted after this time.
5. CANCELLATION, RESCHEDULING & OTHER CHANGES
CANCELLATION & NO-SHOW
For any cancellation or reschedule requests received by the Artist no less 72 hours prior to the Client's session date and time, the Client will be refunded the deposit or have a choice to credit the deposit towards a new session date.
For any cancellation or reschedule requests received by the Artist within 72 hours of the Client's session date and time, the Deposit will not be refundable. Subject to any pricing changes by the Artist, the Artist will issue a new invoice for a new deposit for a reschedule request.
If the Client does not show up to their session, the Client acknowledges that they have forfeited their Deposit and the balance of the Invoice will be immediately due and payable as a No-Show Fee.
If the Client arrives at the shoot 25 minutes late, the Artist will automatically consider that a No-Show and the above applies.
CANCELLATION OR RESCHEDULING DUE TO UNFORESEEN CIRCUMSTANCES
In the event that the Client must cancel due to an unforeseen circumstance, the above terms will not apply. This will be at the Artist’s discretion and assessed on a case-by-case basis.
Unforeseen circumstances include:
Serious illness or medical emergency; or
Personal matter; or
Accidents or unexpected injuries; or
Sudden onset of natural disaster or epidemic.
6. PAYMENT
A 50% deposit must be paid upfront in order to secure the booking. The Deposit is non-refundable within 48 hours of the scheduled shoot date.
The agreed shoot date will be tentatively held for 3 business days. If the Deposit is not paid within this timeframe, the shoot date will be released and made available for other bookings.
The remaining amount is due 7 business days after the agreed shoot date.
If the Client fails to pay within the timeframe outlined, the Client will be charged an additional 5% per day overdue.
Fees are non-refundable, unless stated otherwise.
The Artist reserves its rights to withhold the release of any photographs to the Client until the Invoice has been paid in full.
7. LIMITATION OF LIABILITY
The Artist’s total liability to the Client in connection with these terms and conditions and your purchase of services shall not exceed the total price paid by the Client to the Artist for the purchase of services.
If for any reason, the Artist is unable to fulfil a booking which the Client has paid for in full (in cleared funds), our liability in relation to any claims the Client may have arising out of or in connection with our failure to fulfil the order, including any direct, indirect, incidental, special consequential or exemplary damages which may be incurred by the Client, including but not limited to any loss or profit, any loss of goodwill or business reputation, costs of procuring substitute goods or other intangible loss, is strictly limited to $500.00.
